By accessing or using Fitlo ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Fitlo is a platform that helps gyms and fitness organizations manage competitions, registrations, and communication. Our service includes:

  • Competition management and registration tools
  • AI-powered receptionist features for email management
  • Gmail integration for unified inbox and automated responses
  • Participant management and leaderboards
  • Payment processing for event registrations

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when creating your account
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account

4. Gmail Integration and AI Features

When you connect your Gmail account to use our AI receptionist features:

  • You authorize Fitlo to access your Gmail messages to provide email management services
  • We use AI to analyze email content and generate suggested responses for your review
  • You remain responsible for all emails sent through the Service, even those using AI-generated suggestions
  • You can disconnect your Gmail account at any time from the Integrations page
  • Our use of Gmail data complies with Google's API Services User Data Policy, including Limited Use requirements

5. User Responsibilities

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe on the intellectual property rights of others
  • Transmit any harmful code, viruses, or malicious software through the Service
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without our permission

6. Payment and Refunds

If you process payments through Fitlo for event registrations:

  • You are responsible for setting accurate pricing and refund policies
  • Payment processing fees apply as outlined in your Stripe Connect agreement
  • Refunds are subject to your event's specific refund policy
  • We reserve the right to modify our service fees with 30 days notice

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Fitlo and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you upload to the Service, but you grant us a license to use, store, and display that content as necessary to provide the Service.

8. Third-Party Services

The Service integrates with third-party services including:

  • Google Gmail API for email access
  • OpenAI for AI-powered features
  • Stripe for payment processing
  • Cloudinary for image hosting

Your use of these third-party services is subject to their respective terms and policies. We are not responsible for the actions or policies of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

While we use AI to generate email response suggestions, we make no guarantees about the accuracy, appropriateness, or effectiveness of AI-generated content. You are responsible for reviewing and approving all communications sent through the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITLO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may also terminate your account at any time by contacting us at hello@fitlo.co.

Upon termination:

  • Your right to use the Service will immediately cease
  • We will delete your data as outlined in our Privacy Policy
  • Any provisions that should survive termination will remain in effect

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by email or through the Service. Your continued use of the Service after such changes constitutes your acceptance of the new terms.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
